Provides legal counsel and guidance regarding applicable federal, state, and local employment and labor laws to multiple departments within the Company. Provides strategic legal advice on a full range of Railway Labor Act issues, including interpretation and advice on multiple collective bargaining agreements. Handles administrative charges/complaints/investigations; serves as lead counsel at labor arbitrations; manages and partners with outside counsel in arbitration and litigation matters; drafts policies/procedures and other employment-related documents; and conducts employment-related training for Company Leaders. Negotiates on behalf of the Company with various labor organizations as needed.    

Responsibilities The Labor & Employment Attorney will represent the Company generally through interaction with departments within the Company and external parties, with limited supervision of an Assistant General Counsel or other more senior attorney. Specifically, the Labor & Employment Attorney must have the following qualifications:  

- Specialized knowledge of applicable federal, state, and local employment-related laws (e.g., Title VII, FMLA, ADA, leave laws, wage/hour laws, etc.)

- Strong legal research skills

- Experience representing companies in employment litigation and administrative proceedings (e.g., EEOC, DOL, state agencies), including experience with discovery and document preservation processes  

In addition:

- Extensive litigation experience, including experience handling labor arbitrations, writing briefs, and oral arguments is preferred

- Experience in handling or advising on grievance/administrative proceedings and unions subject to the Railway Labor Act a plus

- Experience in working with a unionized workforce and directly with union leadership is preferred

Qualifications BASIC QUALIFICATIONS:  

High School Diploma, GED or equivalent education required.

Must be at least 18 years of age.

Must have authorization to work in the United States as defined by the Immigration Reform Act of 1986.

EDUCATION:

  • Undergraduate and law degrees from accredited schools required.   
WORK EXPERIENCE: 
  • Must have at least four years of experience with a mid-sized to major law firm or in-house legal department as a practicing attorney with a focus on labor and employment law.  
LICENSING/CERTIFICATION: 
  • Must be a current member in good standing of a bar association.  
SKILLS/ABILITIES/KNOWLEDGE/WORK STYLE:
  • Must possess strong PC skills with knowledge of word processing application. Ability to use a computer keyboard with sufficient speed to meet demands of job.
  • Must have good people skills and be able to work effectively with all levels of SWA Employees.
  • Ability to work well with others as part of a team.
  • Proven ability to perform under pressure.
  • Must have judgment sufficient to handle and resolve issues related to sensitive and confidential legal matters.
  • Must have strong interpersonal skills and be able to communicate effectively, both verbally and in writing, with executives and General Counsel Department staff, clients, outside counsel, vendors, and others.
  • Must be willing and able to gain expertise and perform work in new areas of the law.
  • Must have excellent organizational skills and be able to perform efficiently and effectively on multiple projects under tight deadlines.
  • Must have judgment sufficient to handle and resolve issues relating to sensitive and confidential legal matters.
  • Must be able to comply with Company attendance standards as described in established guidelines.

OTHER QUALIFICATIONS:
  • Must be willing to travel when required (e.g., to support the Company's airport development and other projects).
  • Must be able to work flexible schedule to include non-business days and hours as needed to meet client needs.
  • Must maintain a well-groomed appearance per Company appearance standards as described in established guidelines.
  • Must be a U.S citizen or have authorization to work in the United States as defined by the Immigration Reform Act of 1986.
