Performs complex professional legal work on a variety of topics and functions involving the application, interpretation, and compliance of federal and state laws, rules and regulations that govern the ! operation of the Department. Assists General Counsel in providing legal advice and representation to the Department, its officials and employees. Work requires contact with governmental agencies, private entities, and high-level executives and government officials. Employees at this level are virtually self-supervising and assume direct accountability for the work product.

MINIMUM REQUIREMENTS

Education and Experience

Juris Doctorate degree from an accredited law schoolseven (7) years professional legal experience in governmental or administrative law, real estate law, or a corporate/commercial law related field. Specific emphasis on laws related to state Right of Way, disposition of state property, eminent domain and utility relocation is preferred. Must be licensed to practice law in the State of Texas. (Experience requirements may be satisfied by full-time experience or the prorated part-time equivalent.)

ESSENTIAL DUTIES

Reviews, drafts and negotiates contracts, agreements, and other legal documents.

Researches legal issues, and interprets laws, rules and regulations.

Drafts legal positions and confers with General Counsel.

Reviews and renders legal advice on a variety of legal issues through opinions, ! briefs, decisions and orders.

With the Attorney General's Offi! ce, represents the Department in civil actions brought by or against the Department.

Researches, frames issues and prepares briefs for formal Attorney General's request to be submitted by the Transportation Commission or the Executive Director.

Drafts departmental rules and regulations for incorporation in the Texas Administrative Code.

Coordinates the disposition of surplus property.

Drafts and reviews or assists in drafting and reviewing bills or amendments for legislative consideration.

Formulates and recommends rules and policies.

Negotiates settlements of complaints filed.

Attends and testifies at legislation hearings.

Represents the Department at local, state and federal levels; drives to perform these duties.

Performs other job-related duties as assigned.

CONDITIONS OF EMPLOYMENT

Driver 's record check will be conducted by the Department. Satisfactory driving records are required for driving state or personal vehicles and motor driven equipment to conduct agency business.

Must attend work regularly and observe approved work hours.

External final applicants for any department position who could potentially be required to drive for the department must pass a drug test prior to employment and will be subject to reasonable cause testing during employment.

External final male applicants who are 18-25 years of age will be required to furnish proof of registration or exemption from registration with the Selective Service System.

Successful completion of a post-offer/pre-employment physical exam at the employer's expense i! s required.

If hired, employee must provide document(s) within! three(3) days of hire date that establish identity and employment eligibility. A complete list of acceptable documents is on file with the local Texas Workforce Commission office.

Department employees or family members will not have, either directly or indirectly, any financial or other personal interest in a department (or a TxDOT) contract or subcontract of any kind. A contract may not be awarded to an entity that is owned in whole or in part by any TxDOT employee or immediate family member.

As part of its employment process, TxDOT may procure or have prepared a criminal background check. An applicant with an unsatisfactory criminal background check report is ineligible to be hired for the position for which the report is initiated.
